Epic Games has recently announced a harsh crackdown on cheaters in its Fortnite game, and that means not only blocking cheaters, but also legal action in connection with copyright infringement. This could now backfire because in one case the mother of the defendant appeared in court.

The Epic Games title Fortnite recently got a free-to-play mode subtitled Battle Royale. This has also proved to be a great success and with this came those players who are not quite so honest or have some shady means of success.

Game providers fight against cheaters naturally, mostly with the help of bans, ie by banishing these users. But there are always players who are not deterred by it. Epic Games has had or wanted to resort to more drastic methods in some cases and sued these users for copyright infringement. For the cheaters are said to have infringed, inter alia, by code manipulation and the use of special software against Epic copyright.

This is a pretty drastic measure and some people think that goes too far. This seems to confirm a report by TorrentFreak : One of the defendants turned out to be a minor. And his mother was probably more than angry, but not only on her 14-year-old son.

Because she appeared in court without a lawyer and said, “This company is trying to sue a 14-year-old child.” And as such, he could not be sued directly. The mother did her homework without a lawyer and told the court that Epic had no proof that her son had manipulated the game. In addition, the End User License Agreement (EULA) is not legally binding, since minors need the consent of a parent or guardian. The mother did not give this, she writes.

She also states in a statement to the court that she does not believe Epic is losing the company through cheaters because it’s a free-to-play title. She says that her son is a scapegoat for Epic Games not getting the cheating under control. Moreover, Epic should not sue the cheaters, but those sites offering such software.
